This paper takes a theoretical approach to examining the justification for punishing child soldiers for war crimes. The author uses a wide range of academic literature from the field of Politics, Philosophy, Sociology, Media, Law and Psychology to explain this very complex issue surrounding child soldiers. The author is inspired by Omar Khadr s case, a young soldier who has been detained since he was at the age of 15, November 2002, in Guantanamo Bay and tried for alleged war crimes. The paper analyses this apparent breach of international law through an ethical lens with the hope that it can find a real justification for punishing child soldiers who commit atrocities. The author goes through controversial issues such as childhood being a social construct and children being rational moral agents, the diffusion of combatant s responsibility for war crimes and the moral justification of punishment. Victor Roman

Victor Roman (né le 12 mars 1937 à Mărtiniș dans le județ de Harghita en Roumanie, mort le 12 avril 1995) était un sculpteur roumain.

Biographie

  • En 1950 Victor Roman quitte son village pour le lycée des Beaux-arts de Târgu Mureș.
  • 1954 Il entre à l'institut d'arts plastiques Nicolae Grigorescu de Bucarest.
  • 1962 Première exposition personnelle à Bucarest.
  • 1963 Prix de sculpture de l'union des artistes plasticiens de Roumanie.
  • 1965 Premier voyage à l'Ouest.
  • 1974 Prix du concours pour la réalisation d'une œuvre d'art pour l'Hôte de ville de Bobigny.

Victor Roman a réalisé de nombreuses œuvres monumentales pour l'architecture et la cité (entre autres l'hôtel de ville de Bobigny, le CES Albert Schweitzer à Créteil, le SCIC à Villiers-le-Bel, la place à Noisy-le-Sec).
